Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was detained in immigration custody.

In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

The court, who was overseeing his petition to removal in a federal court, determined that he must now comply with the terms of his release from jail in Tennessee. This order shifts his supervision to the Tennessee court.
